The suspect as DG JUR provides legal opinions to the European Council and has therefore, a direct ability and responsibility to prevent European Council decision regarding migration policies that do not respect the rule of law.However, the suspect did not intervene at any point between 2013 and 2019 based on the rule of law or to call attention to the violations of international humanitarian and international criminal law. The lack of interventions by the suspect were confirmed by two of his colleagues (See Europeac Council Report, DG JUR).

Concerning Operation Sophia, the suspect participated in every step of its process, whereas most legal questions were discussed at the Working Groups level as well as the Political and Security Committee and were usually cleared by the time they reached the level of Coreper or the Council itself.
